Terms and Conditions for Alchemy Recycling Service

The Recycling Service (as defined below) is provided by Alchemy Telco Solutions Taiwan Co., Ltd

(“Alchemy”) through APPLE ASIA LLC, TAIWAN BRANCH and any of its affiliates and subsidiaries (collectively “Apple”) at no cost to the Customers (as defined below).

These terms and conditions (“Agreement”) constitute a legally binding agreement between Alchemy and the Customer for the Recycling Service. By offering to trade in the Product or otherwise using the Recycling Service, the Customer shall be deemed to have understood, accepted and agreed to be bound by the terms and conditions of this Agreement. If the Customer does not agree to the Agreement, please immediately stop using the Recycling Service.

1. Definitions

“Recycling Service” means the trading-in, reuse and/or recycling of the Products or their parts, and any other related services provided by Alchemy.

“Customer(s)” means the undersigned owner of the Product.

“Product(s)” means iPhone, iPad or such other Apple products as nominated by Alchemy and Apple from time to time for the purposes of the Recycling Service.

“Eligible Device(s)” means any Product (iPhone or iPad or such other Apple products as nominated by Alchemy and Apple from time to time) that is eligible for this Recycling Service as determined by Alchemy and Apple in their sole discretion.

2. The Customer’s representations and warranties

The Customer hereby represents and warrants that:

  • the Customer is the sole owner of the Eligible Device; there are no liens, encumbrances or security interests in or attached to the Eligible Device; and the Customer is legally entitled to sell or otherwise dispose of the Eligible Device.

  • the Customer is not and does not represent nor act as an agent for an Apple reseller.

  • the Customer is at least 18 years old.

  • the Customer resides in Taiwan.

  • the Eligible Device is not counterfeit, stolen or fraudulent.

  • the Eligible Device does not infringe on any third party intellectual property right (including copyright, trademarks, patent, trade secret or other proprietary right.)

  • the Customer has provided no false statements regarding the functionality, condition, or other important information of the Product.

  • The Customer has removed the sim-card from the device

  • The Customer releases us of any liabilities or claims that may arise if you send the Product to us in breach of this warranty.

  • Upon the Eligible Device pick up, the Customer disclaims any further right to any packaging used.

  • All packaging and device accessories (including but not limited to wired or wireless earphones, Apple Watch band, keyboard, mouse, cables, power adapter, screen protector, case, and SIM card pin etc.) will not be returned once sent in, regardless of cancellation of trade-in.

3. Personal Identification

In accordance with Privacy Policy published by Alchemy, Alchemy may require the Customer who wishes to use the Recycling Service to submit the personal data (e.g., Name, ID number, Address and Signature) or other data as requested by Alchemy to the extent necessary, Apple or other person designated thereby in accordance with applicable laws and regulations. The Customer acknowledges, understands and agrees that, if the Customer fails to meet this requirement, Alchemy may not accept the Customer’s application and may prohibit the Customer from using the Recycling Service. Alchemy may provide the law enforcement agencies with such documents or other information regarding the Customer if required under the applicable laws and regulations.

4. Apple is an agent of Alchemy

The Customer understands, acknowledges and agrees that Apple is acting as an agent for Alchemy and that Apple is only collecting the Eligible Device(s) on behalf of Alchemy. To the extent permitted by applicable law, Apple hereby disclaims and excludes any and all warranties of any kind, express or implied.

5. Ownership transfers to Alchemy

Upon Apple or Alchemy receiving and accepting the Eligible Device, ownership of that Eligible Device transfers directly to Alchemy, and the Customer disclaims any further right, title or interest in and to the Eligible Device or any items contained therein. The risk of loss, damage or destruction to the Eligible Device shall be assumed by the Customer until Apple or Alchemy receives and accepts the Eligible Device.

6. Assessment of a value of the Eligible Device

Alchemy or Apple, acting as an agent for Alchemy, will advise the Customer of the assessed value of their Eligible Device. This is the value Apple will on behalf of Alchemy pay the Customer for the Eligible Device in the form of a credit toward a purchase of the Apple and/or Beats products. Alchemy or Apple makes no representation about the market value of the Eligible Device or the price the Customer may be able to obtain elsewhere.

(1) The Assessment in the store

Apple, acting as an agent for Alchemy, will advise the Customer of the assessed value of their Eligible Device based on the information given by the Customer. If the Customer accepts the assessed value in the store, Apple will on behalf of Alchemy give the Customer an instant credit toward a purchase of new Apple and/or Beats products.

(2) The Assessment online

The assessed value that Alchemy or Apple initially provides based on the information given by the Customer (the “Initial Assessed Value”) is valid for 14 days, and the Customer who accepts the Initial Assessed Value shall ensure that Alchemy [or Apple] would receive the Eligible Device within this time frame. Alchemy [or Apple] may inspect the Eligible Device upon the receipt thereof. The Customer understands, acknowledges and agrees that the Initial Assessed Value may be changed after inspection of the Eligible Device by Alchemy [or Apple]. The Customer is obliged to respond to Alchemy [or Apple] on whether the Customer agrees to the changed value within 14 days from being notified by Alchemy [or Apple] of the changed value. If Alchemy [or Apple] does not receive the Customer's response or confirmation within said period, the changed value shall be deemed as agreed to by the Customer.

The Customer may not cancel the trade-in of the Eligible Device after Alchemy [or Apple] revived the Eligible Device under any of the following circumstance:

(i) the Initial Assessed Value has not been changed; or (ii) the Customer agrees, or is deemed as to agree, to the changed value and chooses to receive a credit.

The Customer who disagrees to the changed value may request Alchemy [or Apple] to return the Eligible Device.

7. Credit for new products

For and in consideration of the sale of the Eligible Device to Alchemy, the Customer shall receive a credit for the assessed value which may be utilized by the Customer for your current purchase of new Apple and/or Beats products. Please note that all Apple and Beats products purchased at a physical Apple Store in Taiwan cannot be returned or exchanged under this Agreement.

8. Alchemy’s termination

Alchemy is entitled to cancel or terminate the Agreement with the Customer if Alchemy has a reason to believe that the Customer has provided a false statement, the Customer was not a lawful owner of the Eligible Device, any liens, encumbrances or security interests are attached to the Eligible Device, or otherwise the Customer has breached the Agreement. In this event, the Customer shall return the amount equivalent to credit awarded thereto as well as pay Alchemy compensation equivalent to the credit awarded to the Customer.

9. General terms and conditions

This Recycling Service is provided for lawful purposes only, and the Customer understands and agrees that:

  • the Customer has sole responsibility for keeping a separate backup copy of any files or data before transferring ownership of the Eligible Device to Alchemy, and that the Customer has taken reasonable steps to remove files and data that are deemed personal or confidential. The Recycling Service does not include data recovery. Apple and Alchemy assume no responsibility or liability for lost files or data.

  • the Customer is solely responsible for ensuring the SIM card and any accessories are removed from the Eligible Device, and agrees that Alchemy and/or Apple are not responsible for any costs arising from their failure to remove the SIM and/or accessories.

  • Alchemy may be required to provide the unique numeric identifier of the Product and the Customer’s personal information under this Recycling Service to certain law enforcement agencies or governmental authorities upon their request. The Customer hereby provides his/her consent for Alchemy to disclose the Customer’s personal information for the aforementioned limited purpose only.

  • to the extent permissible by law, the Customer shall indemnify Apple and Alchemy and any of their directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this Recycling Service, or for any breach of these terms and conditions by the Customer.

  • information collected by Alchemy will be processed in accordance with the Alchemy Privacy Policy, available at: https://www.alchemyglobalsolutions.com/privacy-policy-tw/

  • to the extent permissible by law, Alchemy and Apple will not be liable for any special, indirect, incidental or consequential damages resulting from the Recycling Service.

  • to the extent permissible by law, if Alchemy and/or Apple are liable for any damages incurred by the Customer, the maximum amount of damages payable to the Customer will be the total amount of the credits awarded to the Customer under the Agreement.

  • the Recycling Service may be void where prohibited or restricted by law and may not be available in all Apple locations.

  • to the extent permissible by law, Alchemy and Apple reserve the right to refuse, cancel or limit the Recycling Service for any reason.

  • the Recycling Service is not redeemable and has no cash value.

  • the Agreement shall be governed by and constructed in accordance with the laws of the Taiwan, and the court having jurisdiction over the Customer’s address shall have the exclusive jurisdiction of the first instance regarding all disputes arising relating to the Agreement.

  • Alchemy reserves the right to revise or modify this Agreement at any time. Alchemy will notify the Customer of the contents of the changes and when the changes come into effect, by placing a notice on Alchemy’s website.

台灣煉金回收服務條款與條件

本回收服務(如下定義)由台灣煉金通訊股份有限公司(下稱「台灣煉金」)透過美商蘋果亞洲股份有限公司台灣分公司及其任何分公司和子公司(合稱「蘋果」)無償提供予客戶(如下定義)。

這些條款與條件(下稱「協議」)構成台灣煉金和客戶間就回收服務之具法律約束力的協議。經換購產品或以其他方式使用本回收服務,客戶應被視為已瞭解、接受並同意受到本協議之條款與條件約束。若客戶不同意本協議,請立即停止使用本回收服務。

1. 定義

「回收服務」意謂換購、重複使用和/或回收產品或其零件,以及任何其他由台灣煉金 提供之相關服務。 「客戶」意謂產品之簽字所有人。 「產品」意謂 iPhone、iPad 或此類其他台灣煉金和蘋果不時提出供回收服務之蘋果產品。 「合格裝置」意謂任何台灣煉金和蘋果全權判定合格、可參加回收服務之產品(iPhone、iPad 或此類其他 台灣煉金和蘋果不時提出之蘋果產品)。

2. 客戶聲明與保證

客戶在此聲明與保證:

  • 客戶乃合格裝置之唯一所有人;該合格裝置並無或不附帶留置權、負擔或擔保利益;且客戶在法律上有權販售或處置該合格裝置。

  • 客戶並非且不代表、亦非蘋果經銷商之代理人。

  • 客戶至少年滿 18 歲。

  • 客戶居住於台灣。

  • 合格裝置並非偽造、偷竊或詐欺而來。

  • 合格裝置未侵犯任何第三方之智慧財產權(包括版權、商標、專利、商業秘密或其他所有權)。

  • 客戶對於產品之功能、狀態或其他重要資訊,未提供虛假陳述。

  • 客戶已移除裝置中之 sim 卡。

  • 若您將產品送給我方時違反本保證,則客戶免除我方可能產生之任何責任或賠償。

  • 當認證過的合格裝置取走後,客戶同意不追訴任何有關該包裝的使用權

  • 不論是否取消折抵換購,所有包裝、 說明文件和裝置配件等(包括但不限於有線或無線耳機、Apple Watch 錶帶、鍵盤、滑鼠、連接線、電源轉接器、螢幕保護貼、保護殼、退卡針等)一旦送出,將不予退還。

3. 個人識別

依據台灣煉金發布之隱私權政策,台灣煉金可要求意欲使用回收服務之客戶提交個人資料(例如:姓名、身份證號碼、地址和簽名),或台灣煉金所要求之所需範圍內、蘋果或其他人因此依據適用法律和法規指定之資料。客戶承認、瞭解並同意,若客戶未能符合本規定,台灣煉金可能不接受客戶之申請,並可能禁止客戶使用回收服務。台灣煉金可能會在適用法律和法規之要求下,將此類文件或其他關於客戶之資訊提供予執法機關。

4. 蘋果為 台灣煉金之代理人

客戶瞭解、承認並同意蘋果擔任台灣煉金之代理人,並僅代表台灣煉金收集合格裝置。 在適用法律允許範圍內,蘋果在此免除並排除任何及所有明示或默示之任何種類的保證責任。

5. 所有權轉移至 台灣煉金

蘋果或 台灣煉金一收到並接受合格裝置時,該合格裝置之所有權即直接轉移至台灣煉金,而客戶則放棄任何合格裝置或其內含物件中,或對合格裝置或其內含物件之進一步權利、所有權和權益。合格裝置之遺失、損壞或破壞風險應由客戶承擔,直到蘋果或台灣煉金收到並接受該合格裝置為止。

6. 合格裝置之估價

台灣煉金或作為台灣煉金代理人的蘋果,將告知客戶其合格裝置之估價。這是蘋果將代表 台灣煉金,以換購蘋果和/或 Beats 產品用的折抵點數,付給客戶合格裝置之價格。台灣煉金或蘋果之估價不代表該合格裝置之市價,或客戶可能得以在其他地方獲得之出價。

(1) 店內估價

作為台灣煉金代理人的蘋果,將根據客戶所給予之資訊,告知其合格裝置之估價。若客戶在店內接受該估價,蘋果便會代表 台灣煉金給予客戶換購新的蘋果和/或 Beats 產品之立即折抵點數。

(2) 線上估價

台灣煉金或蘋果根據客戶所給予之資訊初步提供之估價(下稱「初步估價」)於 14 天內有效,接受初步估價之客戶應確保台灣煉金[或蘋果]能在此時限內收到合格裝置。台灣煉金[或蘋果]可能會於收到該合格裝置時進行檢查。客戶瞭解、承認並同意,該初步估價可能會在該合格裝置接受 台灣煉金[或蘋果]檢查後變更。客戶必須於台灣煉金[或蘋果]通知該估價變更之 14 天內,回應是否同意變更估價。若台灣煉金[或蘋果]未於上述時間內收到客戶之回應或確認,則該變更估價應被視為已獲客戶同意。 台灣煉金[或蘋果]在以下任何狀況下恢復合格裝置後,客戶便不得取消該合格裝置之換購:

(i) 初步估價並未遭到變更;或

(ii) 客戶同意,或被視為同意變更估價,並選擇接受折抵點數。

不同意變更估價之客戶,可要求台灣煉金[或蘋果]返還該合格裝置。

7. 新產品之折抵點數

客戶應收到估價之折抵點數,作為出售合格裝置給台灣煉金的報酬,可供您用於目前購買蘋果和/或 Beats 產品。請注意在本協議下,所有於台灣實體蘋果商店購買之蘋果和 Beats 產品,皆無法退貨或換貨。

8. 台灣煉金之終止權

若台灣煉金有理由相信客戶提供了虛假聲明、客戶非合格裝置之合法所有人、該合格裝置附帶任何留置權、負擔或擔保利益,或客戶違反協議之其他情事,台灣煉金有權取消或終止與客戶之協議。在此狀況下,客戶應返還所獲折抵點數之同等金額,並賠償台灣煉金所獲折抵點數之同等金額。

9. 一般條款與條件

本回收服務僅供合法目的之用,且客戶瞭解並同意:

  • 客戶應負起全責,於轉移合格裝置所有權予台灣煉金之前,保留任何檔案或資料之獨立備份副本,以及採取合理步驟移除被視為是個人或保密之檔案和資料。回收服務不包括資料修復。蘋果和台灣煉金不承擔任何遺失檔案或資料之責任。

  • 客戶應負起全責,確保 SIM 卡和任何配件皆已由合格裝置移除,並同意因其未能移除 SIM 卡和/或配件而產生之花費,台灣煉金和/或蘋果毋需負責。

  • 台灣煉金可能需要應特定執法機關或政府主管機關要求,提供其產品之唯一數值識別碼,和客戶在本回收服務中之個人資訊。客戶在此同意台灣煉金基於前述之限定目的,揭露他/她的個人資訊。

  • 在法律允許範圍內,客戶應免除蘋果和台灣煉金及其任何董事、經理人、員工、分公司、子公司或代理人中之任何人,因執行回收服務而起,或由於客戶違反這些條款與條件,而遭受任何索賠要求之賠償責任。

  • 在法律允許範圍內,台灣煉金和蘋果對於回收服務導致之特殊、間接、偶發或後續損害不予負責。

  • 在法律允許範圍內,若台灣煉金和/或蘋果對於客戶招致之損害負有責任,應支付給客戶之最高金額,將為此協議下給予客戶之折抵點數的總額。

  • 回收服務在受法律禁止或限制之情形下可能無效,並且可能無法在所有蘋果營業地點取得。

  • 在法律允許範圍內,台灣煉金和蘋果保留因任何理由拒絕、取消或限制回收服務之權利。

  • 回收服務不可贖回,且不具現金價值。

  • 本協議應受台灣法律管轄,並根據台灣法律擬定,而對客戶地址具管轄權之法院,對因本協議相關而起之所有爭端,應有一審之專屬管轄權。

  • 台灣煉金保留隨時修訂或修改本協議之權利。台灣煉金將以在台灣煉金網站放置公告之方式,通知客戶變更之內容,以及變更生效之時間。
